The tasks of the AI market surveillance authority have been officially transferred to the Minister of Science and Technology in Hungary, following the publication of Government Decree No. 139/2026 (VIII.31.) on the modification of Gov. Decree 90/2026. (V.13.) on the Duties and Powers of the Members of the Government. On the basis of the amendment, the Minister of Science and Technology has become the Minister responsible for business development with regard to AI-related business development tasks. (See Section 168/A. of Gov. Decree No. 90/2026. (V.13.).)
As I wrote earlier, the Minister reposnsible for business development tasks was designated to perform the tasks of the market surveillance authority pursuant to Article 70(1) of the AI Act (the "AI Market Surveillance Authority") and the single point of contact in line with Art. 70(2) of the AI Act. Previously, the Minister for National Economy was considered the minister responsible for business development, and after the formation of the new Government, the Minister of Economy and Energy became the minister responsible for business development, so the market supervision of AI was also transferred to this ministry. Now, this set-up has been amended and the Minister of Science and Technology has been appointed as the member of the Government responsible for business development in respect of AI-related business development tasks, so this Minister will also be responsible for AI market surveillance tasks.
The current legislative amendment essentially clarifies the de facto situation, as the Authority's website - even before the amendment regarding the duties and powers of the members of the Government - contained that "the Authority operates as an organisational unit of the Ministry of Science and Technology."
